Please read these Terms of Service ("Terms") carefully before using TradeNoter. By creating an account or using the service you agree to be bound by these Terms.
1. The Service
TradeNoter is a trading journal and portfolio analytics service operated by TradeNoter ("we", "us", or "our"). The service allows you to record, import, and analyse your personal trading activity.
TradeNoter is a journaling and analysis tool only. We do not provide financial advice, investment recommendations, or brokerage services. Nothing in the service constitutes financial advice.
2. Eligibility
You must be at least 16 years old to use TradeNoter. By using the service you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.
3. Account
You are responsible for keeping your account credentials secure and for all activity that occurs under your account. Notify us immediately at if you suspect any unauthorised use.
You may not share your account with others or create accounts on behalf of third parties without our written permission.
4. Free Trial and Subscriptions
TradeNoter offers a 14-day free trial. No credit card is required to start a trial. At the end of the trial period, continued access requires a paid subscription.
Subscriptions are billed on a monthly or annual basis depending on the plan you choose. Billing is handled by Stripe. You authorise us to charge the payment method on file at the start of each billing period.
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period — we do not offer partial-period refunds unless required by applicable law.
5. Acceptable Use
You agree not to:
- Use the service for any unlawful purpose or in violation of any applicable laws
- Attempt to gain unauthorised access to any part of the service or its underlying infrastructure
- Reverse engineer, decompile, or otherwise attempt to extract the source code of the service
- Upload or transmit malicious code, viruses, or other harmful software
- Scrape, crawl, or use automated means to access the service beyond normal use without our written consent
- Resell or sublicense access to the service without our written consent
6. Your Data
You retain ownership of the trade data and notes you enter into TradeNoter. By using the service you grant us a limited licence to store and process your data solely to provide the service to you.
You can export your data at any time. On account deletion we will remove your data within 30 days.
7. No Financial Advice
TradeNoter provides tools to record and analyse your own trading data. All information, analytics, and metrics displayed are derived from data you provide. Nothing in the service constitutes financial, investment, or tax advice. You are solely responsible for your trading decisions.
8. Intellectual Property
The TradeNoter name, logo, software, and content (excluding your data) are owned by or licensed to us. You may not use them without our prior written consent.
9. Availability and Changes
We aim to keep TradeNoter available at all times but cannot guarantee uninterrupted service. We may modify or discontinue features at any time. We will give reasonable notice of significant changes where possible.
If we discontinue the service entirely we will provide at least 30 days' notice and an opportunity to export your data.
10. Disclaimer of Warranties
The service is provided "as is" and "as available" without warranties of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of Liability
To the fullest extent permitted by applicable law, TradeNoter and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the service, including any trading losses. Our total liability to you for any claim will not exceed the amount you paid us in the 12 months preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless TradeNoter and its operators from any claims, damages, or expenses (including legal fees) arising from your use of the service, your data, or your violation of these Terms.
13. Governing Law
These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles. Any disputes will be resolved in the courts of Wyoming.
14. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or within the application. Continued use of the service after changes take effect constitutes acceptance of the updated Terms.
